Terms and conditions General Requirements and Notes. In choosing Pure Adventures you agree to follow the Travellers’ Guidelines, some of which will be re-enforced on the trip by the tour leader. The tour leader has the right to remove any person who refuses to respect these guidelines. All PURE ADVENTURES trips and their extensions are limited to no more than 8 passengers. If there are groups of more than eight they will be divided into groups of eight or less. PURE ADVENTURES reserves the right to modify itineraries and substitute hotels and accommodation. PURE ADVENTURES reserves the right to cancel or shorten a trip if deemed absolutely necessary, in which event we will refund any unused portion of the trip. We start planning the tours many months in advance and occasionally we might have to make changes to the itineraries because of marine tides, weather and other forces of nature. A valid passport is required for all travellers with at least four blank pages and should be valid for six months after the completion of your trip. Travellers should contact the appropriate consular office for entry requirements pertaining to their trip. Special Dietary requests must be made no later than 30 days prior to the trip. PURE ADVENTURES will do everything in its power to try to meet these needs but is not able to guarantee the availability of requested food. PURE ADVENTURES requires that all participants be covered by appropriated life, accident and medical insurance and that they be financially responsible for such expenses. We recommend that all participants insure their personal property from loss and theft. Pricing and Payment A deposit of $250 per person is required to secure your reservation. To secure reservations on a trip departing within 60 days, a full payment is required at the time of booking. Final payment for all trips is due at least 60 days prior to departure, unless otherwise stated. PURE ADVENTURES reserves the right to cancel reservations that are not paid in full at any time after final payment is due, in which case cancellation charges will apply. PURE ADVENTURES reserves the right to correct promotional or pricing errors at any time, or to increase the Trip Price in the event of cost increases due to currency fluctuations, park fee increases, taxes, or fuel surcharges. Cancellations and Refunds If you cancel your trip, you must do so in writing. Cancellation charges will be calculated as of the date we receive your cancellation. Any applicable refunds will be processed within 30 days of receipt of your cancellation. You will receive a refund equal to your trip price less the following charges per person. Prior to departure ......Charge More than 60days .....deposit only 59-43 days ................55% of selling price 42-30 days ................70% of selling price 29 days - departure.. 100% of selling price If you do not arrive for your trip, if you cancel your trip after the departure date, or if you leave a trip already in progress, you will not receive any refund for any unused portion of your trip. PURE ADVENTURES is not responsible for and will not provide any refund for portions of trips missed due to cancelled or delayed flights. Medical Issues Many of the activities involved are inappropriate for persons with severe health problems or physical disabilities, which inhibit walking or other activities. It is the passenger’s responsibility to judge the appropriateness of these travel activities in regard to his/her physical capabilities. Regretfully PURE ADVENTURES trips are not wheelchair-accessible but we are working to make them more accessible. If you have a condition which requires special equipment or treatment, you must bring and be responsible for all necessary items related to your condition. PURE ADVENTURES cannot accommodate women past their fifth month of pregnancy and cannot accommodate service animals. PURE ADVENTURES reserves the right to decline or cancel your reservation, or to remove you from a trip in progress, if we determine your condition would adversely affect the health, safety, or enjoyment of you or of other participants. If PURE ADVENTURES removes you from a trip in progress, you will not be entitled to any refund of your Trip Price and we shall have no further liability. Immunizations are recommended, and may be required, on our trips. You are required to organize this with your doctor prior to the trip. You must advise PURE ADVENTURES in writing, at or prior to booking, of any physical emotional or mental condition which (a) may affect your ability to fully participate in the trip; (b) may require professional attention during the trip; or (c) may require the use of special equipment. If any such condition arises after the trip is booked, you must advise us in writing immediately. Responsibility As a tour operator, PURE ADVENTURES organizes, promotes, and sells tour programs consisting of certain travel services, including surface, air, and water transportation, sightseeing excursions, and hotel accommodation that PURE ADVENTURES purchases or reserves from various suppliers. We do not own or operate any of these Suppliers. The Suppliers providing travel services for the tour programs are independent contractors, and are not agents or employees of PURE ADVENTURES. As such, PURE ADVENTURES is not responsible for any negligent or willful act or failure to act of any supplier or of any third party. PURE ADVENTURES can accept no responsibility for losses or additional expenses due to the delay or changes in air schedules, theft, loss of (or damage to) baggage or any article belonging to the passengers, sickness, personal health, weather, strikes, fires, explosion, earthquakes, floods, epidemics, force majoure conditions of trails, river levels, road conditions, transportation delays, wars, accidents, chance, acts of God, or other causes. All such losses or expenses will be borne by the passenger. If you are unable to make your departure, it is your responsibility to work with the airline on which you are ticketed to reach your destination. PURE ADVENTURES is not responsible for the costs of any medical treatment you may require during the trip. Under no circumstances is PURE ADVENTURES responsible for the quality of medical care, or lack thereof, you may receive while on the trip.   Applicable Law and Liability In no event shall PURE ADVENTURES be liable for any indirect, consequential, punitive, multiple, incidental, special or exemplary damages, however caused, and whether in contract, tort or under any other theory of liability, and regardless of whether it has been advised of the possibility of such damages. Notwithstanding the foregoing, PURE ADVENTURES’ liability for damages hereunder shall in no event exceed the amount actually paid by you to PURE ADVENTURES for the trip giving rise to the claim. The foregoing limitation of liability shall not apply to liability for death or personal injury to the extent applicable law prohibits such limitation.
